Terms and Conditions for BigIdeasDB

Welcome to BigIdeasDB!

These Terms of Service ("Terms") govern your use of the BigIdeasDB website at https://bigideasdb.com ("Website") and the services provided by BigIdeasDB, including LaunchDB. By using our Website and purchasing access, you agree to these Terms.

1. Description of BigIdeasDB

BigIdeasDB provides users with access to curated databases of real-world problems, product solutions, SaaS ideas, and pain points. BigIdeasDB offers two membership levels: Basic and Pro, both available for a one-time purchase.

2. Membership and Access

Upon purchasing a Basic or Pro membership, users gain lifetime access to the databases and features specified in their chosen membership plan. Details of each plan, including query limits and additional features, are available on the pricing page.

3. No Refund Policy

All purchases are final. BigIdeasDB does not offer refunds for any payment made under any circumstances. This includes, but is not limited to:
- Membership purchases (Basic, Pro, lifetime, or monthly subscriptions)
- LaunchDB "Skip the Line" fees
- LaunchDB advertisement placements
- Any other paid services, features, or transactions

The only exception to this policy is the BigIdeasDB Build Challenge, a voluntary promotional program described in Section 10. Any cashback issued under the Build Challenge is a discretionary reward for meeting the program's published criteria, not a refund, and does not change the final nature of any purchase.

Filing a chargeback or payment dispute does not change this policy. Our chargeback and payment dispute policy is set out in Section 11.

4. User Data and Privacy

We collect and store user data, including name, email, and payment information, necessary to provide our services. For details on data handling, please refer to our Privacy Policy at https://bigideasdb.com/privacy-policy.

5. Non-Personal Data Collection

We use web cookies to collect non-personal data to improve our services and enhance user experience.

6. Marketing Communications

By signing in to BigIdeasDB, you agree to receive newsletters, marketing emails, and promotional communications from us. You may opt out of these communications at any time by using the unsubscribe link provided in our emails.

7. Intellectual Property

The data and insights provided by BigIdeasDB are proprietary. Users are granted access to the data for personal and business use but are prohibited from reselling or redistributing any data obtained through BigIdeasDB.

8. LaunchDB Service

LaunchDB is a product launch platform available to Pro members. The following terms apply:

a) Product Launches
- Users may submit products for launch on LaunchDB
- All submissions are subject to review and approval
- BigIdeasDB reserves the right to reject or remove any launch at its sole discretion
- Launches enter a queue and are scheduled based on availability
- Launch dates are not guaranteed and may be subject to change

b) Skip the Line
- Users may pay a one-time fee to prioritize their launch scheduling
- Skip the Line fees are non-refundable regardless of launch outcome
- Prioritization does not guarantee a specific launch date
- BigIdeasDB reserves the right to modify Skip the Line pricing at any time

c) Advertisements
- Users may purchase advertisement placements on LaunchDB
- Ad placements are subject to availability and queue position
- Advertisement content must comply with our content guidelines
- BigIdeasDB reserves the right to reject, remove, or modify any advertisement
- Ad fees are non-refundable once the ad is scheduled or active
- Ad duration begins when the ad goes live, not when payment is made
- Queued ads will be activated automatically when slots become available

d) Upvotes and Engagement
- Users may not artificially inflate upvotes or engagement metrics
- Any attempt to manipulate rankings may result in launch removal and account suspension
- BigIdeasDB reserves the right to adjust or reset engagement metrics if manipulation is detected

e) Content Guidelines
- Submitted products and advertisements must not contain illegal, harmful, or misleading content
- Users are responsible for ensuring they have the right to promote the products they submit
- BigIdeasDB is not responsible for the products or services promoted on LaunchDB

9. Data Export Add-on

Users may purchase a one-time "Export Add-on" to unlock data export functionality (CSV, JSON) across the platform. The following terms apply:

a) The Export Add-on is a one-time purchase that grants export access for as long as the user maintains an active membership on BigIdeasDB.
b) Export access requires an active membership (Lite, Basic, Pro Monthly, Pro Yearly, or Pro Lifetime). If a user's membership expires or is canceled, export access is suspended until the membership is reactivated.
c) Pro Lifetime members have export access included in their membership and do not need to purchase the Export Add-on separately.
d) The Export Add-on purchase is non-refundable.
e) BigIdeasDB reserves the right to modify export formats, rate limits, or the scope of exportable data at any time.

10. BigIdeasDB Build Challenge

The BigIdeasDB Build Challenge is an optional promotional program that rewards paying members with cashback for building and growing a product based on an idea or pain point from BigIdeasDB. The following terms apply:

a) Eligibility. The Build Challenge is open to members on a paid plan (Lite, Basic, or Pro, whether lifetime or subscription). Free accounts are not eligible.

b) Reward tiers. A member may earn cashback by reaching one of the following verified milestones with a product clearly based on BigIdeasDB:
- Ship It: build and publicly launch a working product, for 25% cashback.
- First $1,000: the product reaches $1,000 in total verifiable revenue, for 50% cashback.
- $10,000: the product reaches $10,000 in total verifiable revenue, for 100% cashback.

c) Single, non-additive reward. A member may receive cashback for the single highest tier they reach. Rewards do not stack. Cashback is limited to one reward per member.

d) Discount and coupon exclusion. The 25% Ship It tier is not available on purchases made using any discount, coupon, or promotional code. The $1,000 and $10,000 revenue tiers remain available regardless of any discount used at purchase.

e) Calculation and payment. Cashback is calculated on the amount the member actually paid, excluding taxes and processing fees, and is returned to the member's original payment method.

f) Verification. The member must email proof of the qualifying milestone (a live product URL and, for the revenue tiers, evidence of real and verifiable revenue) to ompatel@om.bigideasdb.com. All submissions are reviewed manually. BigIdeasDB reserves the right to verify claims and to approve or deny any submission at its sole discretion to keep the program fair.

g) Modification. There is no deadline to qualify. BigIdeasDB reserves the right to modify, suspend, or end the Build Challenge at any time, except that submissions already approved will be honored.

11. Chargeback and Payment Dispute Policy

a) Contact us first. If you believe there is a billing issue, contact us at https://bigideasdb.com/contact or ompatel@om.bigideasdb.com before contacting your bank or card issuer, so we can investigate and resolve it. Most billing concerns are sorted out quickly once we can look at the account.

b) Evidence based resolution. If a chargeback or payment dispute is filed, BigIdeasDB will provide the card network, bank, or payment processor with evidence of the purchase and of delivery, including account creation and sign-in records, access logs, queries run, data viewed or exported, launches or advertisements delivered, and all related communications. If that evidence shows the purchase was made and that access was delivered consistent with these Terms, BigIdeasDB will dispute the chargeback.

c) Delivery is immediate. Access to BigIdeasDB is granted immediately upon payment. Once an account has been granted access, the service has been delivered. Not using the account, changing your mind, or being dissatisfied with the data is not a billing error and is not a valid basis for a dispute, given the no refund policy in Section 3.

d) Unwarranted chargebacks and the administrative fee. Countering an inappropriate dispute costs us real time and money. If a chargeback is initiated without first giving BigIdeasDB a reasonable opportunity to resolve the concern, or if a chargeback is decided in favor of BigIdeasDB, you agree to pay an administrative fee, plus all bank, card network, and processor fees we incur. Please be aware that this fee is charged automatically to the payment method on file, and you authorize BigIdeasDB and its payment processor to do so. The fee is compensation for the burden of gathering evidence, preparing a response, and countering a dispute that should not have been filed. It is not a penalty on a refund, since no refund is owed under Section 3.

e) Suspension of access. BigIdeasDB may suspend or terminate your account and revoke access, including lifetime access, while a chargeback is open or while any bank fees or administrative fees remain unpaid. Access may be restored once outstanding amounts are paid, at our discretion.

f) Collection. BigIdeasDB may engage a collection agency or pursue legal remedies to recover unpaid amounts, bank fees, administrative fees, and reasonable costs of collection.

g) Misrepresented disputes. Filing a dispute that misrepresents the facts of a purchase, for example claiming a transaction was unauthorized when it was made from your own account, is a breach of these Terms and may be reported to our payment processor and to the relevant authorities.

12. Governing Law

These Terms are governed by the laws of Canada.

13. Updates to the Terms

BigIdeasDB may update these Terms periodically. Users will be notified of significant changes via email.
